STORE POLICIES

 

US SHIPPING

Orders are processed the same or the next business day from our shop in PA depending on the time the order was placed. Orders typically ship 1-3 business days after being processed. However, custom orders, engine kits and bikes may take longer. All battery packs are considered custom orders and will be shipped 1-10 business days.

All orders will receive FedEx, USPS or UPS tracking the day it ships. DHL – other countries

If the order will take longer to ship due to backorders or a very large order size, an email will be sent.

Do NOT leave a note in your order asking for special shipping timeframes as we cannot guarantee they’ll be honored.

All orders that are refused or undeliverable are subject to extra shipping fees and potentially a restocking fee of up to 20%.

All packages leaving our warehouse are carefully packaged and inspected for accuracy. If you receive a package that appears to be damaged, please inspect in presence of carrier before signing.

All damage claims will be made within 24 hours with their respective carrier and we will ship you replacement item after the claim has been processed and reimbursed to us, the seller. Please see Returns/Damages for details.

We are unable to ship to Po Boxes.

Billing addresses must be used during checkout, as we must ship to the billing address. If your billing address is different from your shipping address, please checkout using Paypal.

INTERNATIONAL SHIPMENTS

There is a flat fee of $150 International Shipping Cost, plus the rate per item. Payment of the line item “Shipping Commitment” is an estimated cost of your shipping fee. The final fee could be more/less than calculated. Upon shipping your item, we will notify you with any unforeseen shipping costs that exceed your “Shipping Commitment” payment.

As the customer, you will be held responsible for the cost to ship into your country. This includes the Tarif tax, Customs and Duty Taxes. We will be in contact with you in order to provide you the full procedure and estimated time of shipment/arrival.

ORDERS, PAYMENTS, AND TAX INFORMATION

All orders are processed on a first come, first serve basis.

Our store accepts credit/debit card payments and Paypal.

All orders shipped within the state of PA will incur sales tax at 6-8% depending on your local sales tax rate. If you are purchasing the items for resale and have a valid sales tax license/ID then be sure to include it in your account profile and we will provide you with a discount code to use to take off the sales tax.

CANCELING ORDERS

Buyers have 24 hours to contact Customer Support in order to cancel an order. After your the 24 hour period, it is not guaranteed that your order can be cancelled.

Once an item has shipped, buyers must contact our Customer Service and will follow or Return Policy before being refunded.

All refunds on cancelled orders incur a 3% credit card processing fee, as per Square and Paypal’s updated refund policy. All credit card refunds will be to the total order amount, minus the 3% credit card processing fee.

RETURN POLICY

Our return policy allows customers to return unused, undamaged, new condition products within 30 days from the day of purchase. After 30 days, unfortunately we can’t offer you a refund or exchange.

Return Rules: Buyers must follow the Return Instructions, incurring the shipping fees to return the product. Once the product is returned, items are inspected for damages or signs of use. Refunds without signs of use will be given, minus the 18% Restocking Fee (Restocking fees include the 3% credit card processing fee and will not be charged separately). If the item is returned in damaged or used condition, the buyer is not eligible for a refund.

Return Instructions:

1. Orders that are eligible for return will be provided a RMA form that must be printed and placed in every package being returned.

2. All packages must be carefully packed and shipped to our Returns Department address that is provided on our RMA form.

3. Once all packages are received to our Returns Department address, they will be inspected for signs of use or damage.

4. After the receive a clear inspection, a refund will be provided minus the 18% restocking fee. The restocking fee includes the 3% credit card processing fee and will not be charged separately.

5. Orders that are NOT fully returned to the address provided and show signs of use or damage will not be eligible for a refund.

CLEARANCE ITEMS: If an item is marked as “Clearance”, all sales are final. Items marked as “Clearance” are NOT eligible for a return.

SPECIAL ORDER ITEMS: If you purchase items that are made to order for you (for example battery packs or special order cells) we generally only accept returns if the products are defective.

Under no circumstances will we accept returns 60 or more days from date of purchase.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging if applicable.

If your batteries are returned with any damage (including to wraps), markings, scratched off authenticity sticker, etc. – you will not be eligible for a refund.

Exceptions to this policy exist only if the return is due to our error or in some cases are eligible for a partial refund.

We don’t guarantee that we will receive your returned item. If you fail to send it using an insured/tracked method, we cannot be responsible for returns lost in transit.

DEFECTIVE PRODUCTS

All Products

If you believe you received a defective product, you must contact us within 14 days of receiving your order. We can offer no guarantees if you contact us beyond the 14 day period.

Engines/Engine Kits/Motorized Bike Kits

Buyers have 30 days from the day it was received to build the engine kit and get it started. Once the engine has started, it is deemed undefective and is no longer eligible for return. During the 30 day warranty period, buyers is required to contact us for technical assistance, missing parts, damaged parts or any issue related to the order. Technical service is provided by emailing info@bicyclemotorworks.com. If technical service has concluded an item(s) defective, items will be replaced at no expense to the customer.

Note: Paint chips, minor scratches, excess grease do not deem a product defective.

E-Bike Batteries

Purchasers must read eBike Battery 101 and acknowledge during checkout that they have read and understand the information provided. By acknowledging our Terms and Conditions, you agree not to misuse your eBike Battery as per our eBike Battery 101 Guideline.

If a battery is defective, you must CONTACT US within 14 days of receiving your order. Having a defective battery on arrival is defined as being damaged from shipping, will not hold a charger or have other initial issues after first charge/usage. We only guarantee that batteries will NOT be dead on arrival.

Failure to either charge batteries, or use of batteries beyond manufacturer’s specifications, WILL render you ineligible for ANY warranty.

Cosmetic Issues with Batteries

Due to the heat-shrink wrap used to wrap batteries, some imperfections, like wrinkles, are considered normal in the manufacturing process and do not impact the function of the battery. If you have any questions about the integrity of the wrap, please email us photos, and discontinue use of the battery. Batteries with tears/holes in the wrap should not be used. If your battery arrives with a tear/hole in the wrap we may do any of the following (at our discretion): replace the battery, send you a replacement wrap, or issue a refund.

Given the consumable and easily damaged nature of batteries, we regret that we cannot be responsible for any issues that occur more than 90 days after your order has arrived for ANY reason.

*Replacement is at our sole discretion and may be denied.

NO SETOFF.

Buyer shall not, and acknowledges that it will have no right, under this Agreement, any other agreement, document or law, to withhold, offset, recoup or debit any amounts owed (or to become due and owing ) to Seller or any of its affiliates, whether under this Agreement or otherwise, against any other amount owed (or to become due and owing) to it by Seller or its affiliates, whether relating to Seller’s or its affiliates’ breach or non-performance of this Agreement or any other agreement between Buyer or any of its affiliates, and Seller or any of its affiliates, or otherwise.

INDEMNIFICATION.

Buyer shall indemnify, defend and hold harmless Seller and its officers, directors, employees, agents, affiliates, successors and permitted assigns (collectively, “Indemnified Party”), against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, fees and the costs of enforcing any right to indemnification under this Agreement and the cost of pursuing any insurance providers, incurred by Indemnified Party/awarded against Indemnified Party in a final non-appealable judgment, relating to/arising out of or resulting from any claim of a third party or Seller arising out of or occurring in connection with the products purchased from Seller or Buyer’s negligence, willful misconduct or breach of this Agreement. Buyer shall not enter into any settlement without Seller’s or Indemnified Party’s prior written consent.

CONFIDENTIAL INFORMATION.

All non-public, confidential or proprietary information of Seller, including, but not limited to, specifications, samples, patterns, designs, plans, drawings, documents, data, business operations, customer lists, pricing, discounts or rebates, disclosed by Seller to Buyer, whether disclosed orally or disclosed or accessed in written, electronic or other form or media, and whether or not marked, designated or otherwise identified as “confidential,” in connection with this Agreement is confidential, solely for the use of performing this Agreement and may not be disclosed or copied unless authorized by Seller in writing. Upon Seller’s request, Buyer shall promptly return all documents and other materials received from Seller. Seller shall be entitled to injunctive relief for any violation of this Section. This Section shall not apply to information that is: (a) in the public domain; (b) known to the Buyer at the time of disclosure; or (c) rightfully obtained by the Buyer on a non-confidential basis from a third party.

IMPORTANT NOTICE ON E-BIKE BATTERIES:

•    Do not open or remove any part of this battery pack. Do not modify the pack in any way – including cutting wires, using connectors that are not compatible with the pack, hard-wiring the pack into a motor or controller, etc. ANY modification of this pack will void any and all warranty, either implied or expressed.

•    Charge this pack ONLY with the appropriate lithium ion charger. If you aren’t sure which charger you should use please co tact us to verify.

•    If this pack is damaged or gets wet do not use it. Danger of fire or thermal runaway of cells can occur, and this can be a life threatening issue. Dispose of a damaged or wet pack immediately by contacting your local hazardous waste disposal office.

•    We encourage customers to recycle all batteries through Battery Recyclers of America. More information about recycling your used batteries can be found on our website under Resource Center.

Chargers

If you believe you have received a defective charger, you have 30 days to contact us for further instructions.

 

REFUNDS (IF APPLICABLE)

Once your return is received, we request 1-2 weeks to inspect your return.

If you are approved, you will receive a notification email, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment. The 18% restocking fee will be deducted from your refund amount. (Restocking fees include the 3% credit card processing fee.)

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

If you’ve done all of this and you still have not received your refund yet, please contact us at info@bicyclemotorworks.com.

Return Shipping

You will be responsible for paying for your own shipping costs for returning your item, unless the return is due to our error. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Returning Batteries

If you are shipping batteries, you recommend you ship them UPS Ground or Fedex Ground. Please contact us for specific instructions before sending your package!

Returning other items (non-batteries)

You can choose to return these items using whatever service is most economical for you.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item. If you fail to send it using an insured method, we cannot be responsible for returns lost in transit.

MANUFACTURER RATINGS

All ratings, including rated capacity, max pulse discharge current, and continuous max discharge current are determined by the manufacturer.

BicycleMotorWorks.com does not certify or otherwise guarantee the validity of these ratings or the suitability of these batteries for any particular application.

Purchaser agrees that responsibility for verifying ratings and validity of battery for any application lies solely with the purchaser, and that choosing the wrong E-Bike Battery or charger can result in severe personal injury or even death. Purchaser agrees that Bicyclemotorworks.com accepts no responsibility should battery prove unsuitable, unsafe, or otherwise unfit for their use. If battery is purchased for resale, purchaser agrees to forward all warnings to buyer, and assume responsibility for such.

No Warranties beyond 30 days, under the limitations defined above.

SELLER MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE GOODS SOLD ON THIS WEBSITE, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY OR (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. BUYER ACKNOWLEDGES THAT IT HAS NOT RELIED UPON ANY REPRESENTATION OR WARRANTY MADE BY SELLER, OR ANY OTHER PERSON ON SELLER’S BEHALF.

BATTERY WARNING

WARNING: LITHIUM ION BATTERIES MAY EXPLODE OR BURN DUE TO IMPROPER USE. USING THESE BATTERIES FOR PURPOSES NOT INTENDED BY THE MANUFACTURER MAY CAUSE SEVERE INJURY AND DAMAGE.

All rechargeable batteries have inherent risks under any circumstance. Use caution when working with Li-ion (Lithium-ion), LiPo (Lithium-ion Polymer) and any rechargeable cells (together “Rechargeable Batteries”), as they have dangerous charging characteristics and are known to explode or burn if mishandled. A purchaser and user of Rechargeable Batteries should educate themselves on Rechargeable Batteries, especially as to charging, discharging, assembly and storage. We are not responsible for any damage caused by misuse or mishandling of Rechargeable Batteries.

Here are a few tips:

•    Always charge these batteries on and within fire-proof material.

•    Never leave Rechargeable Batteries in a recharging station unattended.

•    Do not use any Rechargeable Battery or charger if any visible damage is present, or if known mishandling, accidental or otherwise, has occurred.

•    Always store and transport rechargeable cells in a safe, non-conductive container.

•    Properly dispose of all battery cells and chargers in accordance to local laws and mandates (if you’re unsure, call your local municipality). 

•    We encourage our customers to recycle our eBike Batteries, including all battery types through Battery Recyclers of America. Information about recycling all batteries can be found on our website under Resource Center.

•    If a Rechargeable Battery overheats, hisses, or bulges, immediately quarantine the battery from any combustible materials. Ideally, take the battery outside.

•    If a Rechargeable Battery catches fire, the FAA recommends pouring water or soda on the battery and surrounding areas. Ideally, use a foam extinguisher to quell the fire.

MOTORIZED BIKE WARNING

Operating any type of bicycle, bike, motorized bicycle, moped bike, bike motors, bicycle motor, bicycle motors, bicycle engine kits, bicycle motor parts, wholesale bicycle motors or use of a motorized bicycle involves some risk of bodily injury. Buyer accepts responsibility for any and all operation of these products that may lead to personal injury, economic loss, social distress, other losses, costs and damages. Bicyclemotorworks.com, (owned and operated by GutenMarkt, Inc.). is not responsible for injuries and/or damages resulting from operating any of these bicycle motor products. Our bicycle motor products such as gas bike, bike motors, bicycle motor, bicycle motors, bicycle engine kits, bicycle motor parts, wholesale bicycle motors or motorized bicycles are not recommended for use by persons under 16 years of age. Please obey all City and county regulations while using your advertising products. Never operate your outdoor advertising products in an unsafe manner. Check with your local and city laws before use of your advertising product(s).

The Buyer understands and acknowledges that operating bicycle motor product(s) entails known and unanticipated risks. Buyer understands that such risks cannot be eliminated by the Seller, GutenMarkt, Inc. without jeopardizing the essential qualities of this activity.

The risks that the Seller, GutenMarkt, Inc. is not responsible for include among other things: falling, collision with pedestrians, street, highway or roadway vehicles, striking obstructions or other person, unsafe weather conditions, unsafe bicycle motor installation, equipment failure, and weather conditions including temperature exposure (hypothermia, sunstroke, sunburn, heat exhaustion and dehydration).

IN NO EVENT SHALL GUTENMARKT, INC. BE LIABLE TO ANY ENTITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION THAT ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE CONTENT, MATERIALS, AND FUNCTIONS OF THE SITE OR ANY LINKED WEBSITE, EVEN IF GUTENMARKT, INC. IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
